Accused of misusing public money
Complainant Shiv Kumar Saxena has said that the accused persons have misused public money by putting up large-sized hoardings on parks, roads, crossings, electric poles, and other public places. The complainant said that a written complaint was lodged at Dwarka South police station on November 15, 2019, regarding the alleged illegal hoardings. He said that one of the hoardings stated that the Delhi government would soon start registration for darshan at Kartarpur Sahib and it carried photographs and names of then CM Arvind Kejriwal – accused number one – and MLA of Matiala constituency Gulab Singh – accused number two.
FIR under Prevention of Defacement of Property Act
It is submitted that in such circumstances, no purpose would be served by allowing the present application, and it is prayed that there is no need to order registration of FIR in the present case. After hearing the submissions, the Additional Chief Judicial Magistrate (ACJM) said, “This court is of the view that the application under Section 156 (3) CrPC is maintainable. Accordingly, the concerned SHO is directed to immediately register an FIR under Section 3 of the Delhi Prevention of Defacement of Property Act, 2007 and no other offence appears to have been committed from the facts of the case.” Vaartha e-paper
